Access and Interference

You agree that your use of the site constitutes activity in Nevada and for the purpose of litigating any dispute arising under this Agreement, you agree that any action commenced against MarketModel.com shall be commenced and maintained solely in a federal or state court of competent subject matter jurisdiction within the jurisdiction of the U.S. District Court for the Clark County of Nevada, Las Vegas Division. You also agree to submit and consent to the personal jurisdiction and venue of any such court in the event MarketModel.com commences an action against you.

If any term or provision of these Terms of Use is finally found by a court of competent jurisdiction to be void, invalid, unenforceable or otherwise contrary to law, the remainder of the Terms of Use, as the case may be, that can be given effect without such term or provision, shall be given full effect.

Any failure by MarketModel.com to enforce strict performance of any provision of the Terms of Use will not constitute a waiver of its right subsequently to enforce such provision or any other provision of the Terms of Use.
